THE CHIEF MAGISTRATE’S COURT AT MOMBASA (Hon D Odhiambo .SRM)
- The Applicant was charged and convicted on his plea of guilty for the offence of offence of BEING IN POSSESION OF NARCOTIC DRUGS CONTRARY TO SECTION 3 (1)(A) AS READ WITH SECTION 3 (2)(a)of the NARCOTIC DRUGS AND PSYCHOTROPIC SUBSTANCES CONTROL ACT NO 4 OF 1994 . The Applicant was sentenced to ONE (1) YEAR imprisonment on the 18TH DAY OF JULY, 2024.
- The sentence review report dated 9TH October, 2024 by JOHN DALLIH indicated that in mate has learnt his lesson and is willing to finish the remainder of his sentence serving the community on a non custodial sentence. The family and community sentiments were also positive and they are willing to receive him.
- Having considered the Sentence Review Report, I find that since the applicant has learnt his lesson . His sentence is reviewed to the time already spent in custody plus a further community service order FOR THREE (3) MONTHS to be served at MIRITINI LOCATION CHIEF’S OFFICE.
- The application for sentence review is allowed.
