THE CHIEF MAGISTRATE’S COURT AT MOMBASA (HON M. MUTUKU C.M)
- The Applicant was jointly charged with another and both were convicted on their plea of guilty for the offence of PREPARATION TO COMMIT A FELONY CONTRARY TO SECTION 308 (1) OF THE PENAL CODE . The Applicant was sentenced to a THREE (3) YEARS imprisonment on the 10th DAY OF AUGUST , 2023.
- The sentence review report 9th October 2024, IN RESPECT TO EMMANUEL MWADIME BY ATIENO BEATRICE OTIENO indicated that in mate has learnt his lesson and is willing to finish the remainder of his sentence serving the community on a non custodial sentence. The family and community sentiments were also positive and they are willing to receive him.
- Having considered the Sentence Review Report, I find that since the applicant has learnt his lesson . His sentence is reviewed to the time already spent in custody plus PROBATION SENTENCE FOR ONE (1) YEAR UNDER THE SUPERVISOIN OF THE VOI PROBATION OFFICE
- A sentence review report be prepared in respect to the 1st accused person
