RULING
I have read the originating motion dated 14/11/2024 brought under Certificate of Urgency and the affidavit in support thereof sworn by Bernard Gitonga on 14/11/2024. From the affidavit, I note that the circumstances and activities surrounding the case culminated to other court proceedings against the respondents. It is deponed that in this court’s ACEC case number E034 of 2024 where the 1st respondent was the respondent, some recovered money was forfeited to the government. It is also deponed that the 1st respondent was arraigned in court in Jomo Kenyatta International Airport Criminal case number MCCR E079 of 2024 together with others. All this web leads to me to a conclusion that the applicant has made a prima fascie case warranting grant of the orders prayed.
Consequently, prayers numbers 2 (i), (ii), (iii), (iv), (v), (vi), (vii), (viii), (ix), (x), (xi); 3; 4; 5; 6 (i), (ii), (iii); 7, 8, 9 and 10 of the originating motion dated 14/11/2024 are hereby granted.
The orders shall remain in force for ninety (90) days upon publication in the Gazette.
