REPUBLIC OF KENYA
IN THE HIGH COURT OF KENYA AT NAIROBI
ANTI-CORRUPTION AND ECONOMIC CRIMES DIVISION
ACEC MISC. NO. E056 OF 2024
ASSETS RECOVERY AGENCY..…..............................................APPLICANT
VERSUS
ANWAR YOGAN MWOK alias KENNEDY YOGAN MWOK....1ST RESPONDENT
HALLINGTON ARUM MWOK HANDA ................................2ND RESPONDENT
RULING
I have read the Originating Motion dated 7th November 2024 and the accompanying affidavit of Martin Samburumo sworn 7th November 2024 in support thereof. Upon reading the same I note that the property being sought to be preserved was subject of a criminal trial in Milimani Criminal Case Number 538 of 2017 in which one Rose Awinja Ondumbu is said to have been convicted of terrorism related charges and the property was as a result subject of forfeiture to the government. Based on this apparent evidence, together with other reasons and grounds advanced in the Originating Motion and the supporting affidavit, I am convinced that the Applicant has made up a case for preservation of all that property known as L.R. No. Nairobi Block 157/826 (formerly L.R No. Kiambu/Dandora/651 (New Survey No. 826)
In view of the above, the court grants and allows Prayer (b), (c), (d), (e) and (f) of the Originating Motion dated 7th November 2024. The costs of the application shall be in the cause. The orders so granted shall be effective for 90 (ninety) days from the date of publication of this order in the Kenya Gazette as by law required.
