Ethics and Anti-Corruption Commission VS TURKENYA TOURS AND SAFARIS LIMITED AND DICKSON KIBUNYI MAHIA

High Court at Milimani High Court · · Benjamin Mwikya Musyoki

The appellant has brought originating summons dated 6/3/2026 seeking to preserve funds held in Equity Investment Bank Account number 147488-0004 in form of government securities. I have read the application and supporting affidavit sworn by Margaret Wambeli Ngari on 6/3/2026.

It is deponed that the respondent’s funds sought to be preserved have been trailed to corrupt acts of several persons working in Sports, Arts and Social Development Fund (SASDF) and the State Department for Sports and Arts. These acts include embezzlement of public funds, abuse of office, bribery and kickbacks. The funds which amount to Kshs. 3.8 billion were purportedly disbursed as payments for air-ticketing services rendered by companies contracted by SASDF and the State Department for Sports and Arts.

The amount being investigated is substantial and I am convinced that the applicant deserves time to complete its investigations. Leaving the funds (which by their nature can be liquidated fast and easily) free and available to the respondents will no doubt compromise not only the quality of the investigations but also their integrity.

In the circumstances, I grant the originating motion in terms of prayer 2 and 3. There shall be no orders as to costs.

Dated, signed and delivered at Nairobi this 6 th day of March 2026.
