I have considered the Originating Motion dated 7th November 2024, the grounds on its face and the facts deposed to by Martins Samburumo in the Supporting Affidavit. I am satisfied that there are reasonable grounds to believe that motor vehicle Registration No. KDH 690D Chasis No. 21 MBA IM400960831 Nissan Note which is registered in the name of Esther Wambui Wachira, may have been used to commit a crime.
In the premises the Originating Motion is allowed and Prayers 2, 3, 4 and 5 of the same are granted.
The preservation order shall be for a duration of ninety (90) days as provided in Section 84 of the POCAMLA and is to be served upon the Respondent within 21 days of today’s date. Orders accordingly.
