Wells Fargo Limited VS Private Security Regulatory Authority

High Court at Milimani High Court · · Jairus Ngaah

I have considered the applicant's application dated 11 January 2023 filed under a certificate of urgency of even date. Although the respondent is alleged to have delayed in processing the applicant's licence, there is no or no sufficient reason given why the applicant did not move the court for leave at the earliest opportunity possible. For this reason, I will not certify the applicant's application as urgent. Nevertheless, leave is granted in terms of prayer 2 of the application. The prayer for interim relief at this stage is refused. The applicant is directed to file and serve the substantive motion within seven days of the date of this ruling. The respondent shall file and serve its response within seven days of the date of service of the applicant's motion. The substantive motion, if filed as directed, shall be mentioned on 1 February 2023 for directions on the mode of its disposal. It is so ordered.
