WAIYAKI WAIRIMU VS Institute of Certified Public Secretaries Of Kenya

High Court at Milimani High Court · · Jairus Ngaah

I have read the applicant's application dated 17 May 2024 filed under a certificate of urgency of even date. The decisions complained of for which leave is sought to apply for an order of certiorari were apparently made in January and February 2024. It is not clear why it has taken the applicant at least three months to  file the instant application. Suffice it to say, because of the delay, I am hesitant to certify the application urgent. Nonetheless, leave is granted for the applicant to file the substantive motion for the judicial review orders of certiorari and prohibition in terms of prayers (c) and (d) of the chamber summons. Leave, however,  shall not operate as stay because the decision sought to be stayed is apparently not any of the decisions  that will be subject to judicial review proceedings in the substantive motion to be filed. I direct that the motion be filed and served within 7 days from today's date. The respondents shall file and serve its response to the motion within 7 days of the date of service of the applicants motion. The directions on the hearing of the motion shall be taken on 11 June 2024. It is so ordered.
