The accused persons JARED CHACHA MAGABE, ISOKERO MAGABE
MWITA ROBI and WEISIKO MAGABE were jointly charged with the offence of murder contrary to Section 203 as read with Section 204 of the penal code Cap 63 of the Laws of Kenya.
Particulars are that the accused persons on the 22nd day of February 2023 at Ihore village, Ihore Sub-Location, Kokeharaka Location, Kuria West Sub-County within Migori County murdered Paul Otaige Kimune.
The 1st and 3rd Accused persons were never arrested and the trial proceeded against the 2nd and 4th Accused persons.
The prosecution’s case was supported by the evidence of 9 witnesses. This court has considered the said evidence and concluded that the prosecution tendered evidence that raises a prima facie case sufficient to place the accused persons on defense. The accused persons have a case to answer.
