I have read the applicant's application dated 20 January 2025 filed under a certificate of urgency of even date. It is not apparent on the face of the application or in the affidavit filed in support of the application when counsel for the applicant became aware of the judgment sought to be appealed against as not to file this application earlier. In the absence of this material evidence, I am not satisfied that the application is urgent. I direct that the same be served for hearing inter partes on 29 January 2025 before Mutai, J.
