I have read the applicant's application dated 2 January 2026, filed under this Honourable Court's vacation Rules and in which the applicant seeks that the main application for interim measures pending the conclusion of arbitration proceedings be admitted for hearing during this Court's Christmas recess. I note from the pleadings that the lease in issue expired on 31 December 2025. It is also apparent from the affidavit filed in support of the application that, as early as July 2025, the respondent notified the applicant that it would not renew the lease upon its expiry, notwithstanding the applicant's intention to have the lease renewed. I also gather from the applicant that, perhaps, because of the expiry of the lease, it is no longer in possession of the leased premises. Against this background, I am not satisfied that the application is urgent as to be admitted for hearing during this Honourable Court's Christmas recess. I direct that the application be served for disposal in the new term. The matter shall be mentioned before Wangari, J., on 19 January 2025 for directions on the manner of its disposal. It iis so ordered.
