Before me is the Notice of Motion dated 21st July 2025 in which Counsel for the accused persons herein sought an order for review of the terms of bond granted to the accused persons by this court.
The accused persons had been granted a bond of Kshs.500,000/- each with two sureties of like amount which Counsel considered unreasonable and beyond the reach of the accused persons.
The application was opposed and was canvassed through written submissions. However, the application has been overtaken by events as all three accused persons did post bond in the terms imposed by this court. That is indicative that the terms were not beyond the reach of the accused persons.
The application having been overtaken by events, there is no point of engaging in an academic exercise and the application is therefore marked as spent and is struck out accordingly.
Orders accordingly.
