' S E N T E N C E
1. The 3 accused were charged with the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code Cap 63 Laws of Kenya. The particulars of the offence are that on the night of 22/23/1/2017 at Gambini Village Chonyi Division within Kilifi County murdered DANIEL NZAI KOMBE.
2. A2 unfortunately passed on before the matter was concluded.
3. The pre sentence reports were all favorable and recommended a sentence of the time spent in custody.
4. I however note the high number of murder over baseless allegations of witchcraft. A detriment sentence is called for.
5. Each of the 2 accused persons that is Aa1 AND A2 is sentenced serve 15 years imprisonment from 7/02/2017.
