' S E N T E N C E
1. The accused PESONS were charged with the offence of murder contrary to Section 203 as read with Section 204 of the Penal Code Cap 63 Laws of Kenya. The particulars of the offence are that on the night of 22/23/1/2017 at Gambini Village Chonyi Division within Kilifi County murdered DANIEL NZAI KOMBE.
2. The 2nd accused person unfortunately passed on towards the tail end of this case. The court then called for pre sentence reports and they were all favourable and recommended a sentence of the time spent in custody.
3. I however note the high number of murder cases over baseless allegations of witchcraft in the locality . A deterrent sentence is called for.
4. Each of the 2 accused A1 and A3 persons is sentenced to 15 years imprisonment from 7/02/2017.
