RULING

  1. The Plaintiff be and is hereby granted occupation of a portion measuring 5 acres on L.R No.KOITOROR/TUIYOLUK BLOCK 1(KOITOROR)/297 pending the hearing of the Intended Appeal in the Court of Appeal arising from ELD OS No. 2 of 2022.
  2. The Plaintiff will only utilize, use and occupy the 5 acres for farming purposes and shall not erect any permanent structures on the said portion until determination of the Intended Appeal.
  3. An order of prohibition be registered on the Register of L.R No. KOITOROR/TUIYOLUK BLOCK 1(KOITOROR)297 prohibiting any alienation and/or registration of any dealing pending the outcome of the Intended Appeal before the Court of Appeal.
  4. Each party to bear its own costs as regards the application before court.
  5. The file is therefore closed.
