RULING

  1. The application dated 13.06.2025 is seeking to alter and/or change the issues in terms of occupation by the parties in the judgement.
  2. Consequently, it is the considered view of the Court that the judge who heard the matter and pronounced the judgment to be reviewed is in a better place to deal with the application.
  3. The file is therefore transferred to Hon. Lady Justice Jane Onyango sitting in Thika Environment and Land Court for further direction.
  4. The file will be mentioned before Hon. Lady Justice Jane Onyango sitting in Thika Environment and Land Court on the 18.09.2025.
  5. The Deputy Registrar Eldoret Environment and Land Court  is directed to ensure the file is transmitted to the Deputy Registrar Thika ELC to be placed before the Honourable Judge on 18.09.2025
  6. The Defence counsel will serve a Mention Notice on the Plaintiff/Applicant within 14 days from today’s date.
