1. By Originating Summons dated 6 th June, 2026, the Applicant seeks orders thus;
1) That the requirements of Section 158(4) of the Children Act be waived as provided for by Section 159 (1) of the said Act.
2) That E.M.M. be appointed guardian ad-litem in this case.
3) That L.W.M. be authorized to adopt H.D. who shall be known as I.N.
4) That the Court be pleased to make any further orders it may deem just and fit in the circumstances.
2. The application is supported by an affidavit deposed by the Applicant, an affidavit of fitness by a guardian ad-litem, a statement in support of the application by the Applicant and a certificate of registration by a foster parent.
3. Notably, the Applicant has not sought an order for the Children Officer to be directed to file a report to ensure legal transfer of parental rights. For that reason, the application succeeds partially, in that I appoint EMM as a guardian ad-litem in the matter.
