RULING.
1. Upon the appellant’s Chamber Summons dated 28th August 2025 coming up for hearing on the prayer for certification of the appellant’s substantive Notice of Motion of even date as urgent and its admission for hearing during the High Court Recess, I have duly considered the appellant’s/applicant’s said application and the supporting affidavit sworn by Paul Kawega on even date and I do note that the appellant has already preferred an appeal against the impugned ruling delivered on 25th August 2025 in Webuye MCCC145/2025 and is at risk of being cited for contempt of court due to none compliance with the orders of the trial court. I thus find that urgency has been demonstrated and proceed to make the following orders:-
i) The appellant’s Notice of Motion dated 28.8.2025 is admitted for hearing during the High Court Recess.
