The Applicant was convicted on his own plea of guilty for the offence of assault causing actual bodily harm contrary to Section 251 of the Penal Code, Cap 63 Laws of Kenya. The trial court sentenced him to pay a fine of Kshs. 5,000/= or serve 6 month’s imprisonment. The Applicant has served 1 month of his sentence. The Sentence Review Report filed on 3rd April 2024 by the Probation Officer Ngetich Nicholas Kibet does not recommend a non-custodial sentence due to hostility from the family and community. I hereby direct that the Applicant continues to serve the remaining part of his sentence in custody.
