RULING
1. Indeed, the matter was fixed for hearing on two days namely 13.04.2026 and 14.04.2026.
2. The matter did proceed on the 13.04.2026 and adjourned to 14.04.2026 when the Plaintiff was to complete his case and Defendant to proceed with their case.
3. Today, the Defendant Counsel is not present and the witness is not present.
4. Counsel for the Plaintiff has confirmed calling the Defendant Counsel but with no response.
5. Consequently, the Court is of the view and finding that there is no reason that the Defendant is not in Court and as such the Defence case is closed.
