RULING
1. The Application dated 14.04.2026 is allowed.
2. The matter is hereby re-opened for hearing in the interest of justice.
3. The Plaintiff will avail the two witnesses who had testified for cross-examination.
4. The Defendant will be given a chance to be heard.
5. The matter will proceed for hearing on 11.06.2026 in open court.
6. In the meantime, the Applicant will pay throw away costs of Kshs.10,000 to the responses within 30 days from today’s date.
