The application dated 30.05.2023 is made under section 36 of the Arbitration Act and is for recognition and enforcement of an Arbitral Award. The Respondent does not oppose the application in principal but avers that he had made substantial progress in complying with the Award although some disagreements have cropped up which I believe can be resolved by the parties.
The application being a formal application to is allowed on the following terms;
1. The Award dated 19.12.2023 is duly recognised as a judgment of this court and leave is granted for the Award to be enforced as a decree of this court.
2. The Respondent shall pay costs of the application assessed at Kshs. 20,000.00.
3. There shall be a stay of execution of 45 days from the date hereof.
4. Mention on 31.07.2023 to confirm compliance and settlement.
