I have read the applicant's application dated 31 January 2023 filed under a certificate of urgency of even date. I am not satisfied that the application is urgent. Nonetheless, leave is granted in terms of prayer 2 of the summons. The prayer for leave to operate as stay is declined. The applicant is directed to file and serve the substantive motion within seven days of the date of this ruling. The respondents and interested party shall file and serve their response within seven days of the date of service of the applicant's motion. The suit shall be mentioned on 1 March 2023 for directions on the manner of its disposal. It is so ordered.
