RULING

1. The Application dated 04.07.2025 is allowed in the following manner;
2. The Land Registrar Uasin Gishu and Land Surveyor Uasin Gishu are directed to visit the two properties known as L.R UASIN GISHU/KIMUMU SCHEME/1405 and 6374 and re-establish the boundaries and location of both properties within 45 days from today’s date.
3. The Land Registrar and Surveyor will file a Ground Report before Court on the Location and position of the properties.
4. The Land Registrar and Land Surveyor will also comment on the persons in occupation of both properties.
5. Every owner will meet the costs of the re-establishment exercise which will be recoverable at the determination of the matter.
6. The OCS of the nearest police station to the two properties is directed to provide adequate security to the Land Registrar and Land Surveyor while the exercise is ongoing.
7. The matter will be mentioned on 24.11.2025 to confirm if the ground report is on record and take further direction.
