RULING
1. Before Court are summons for confirmation of grant dated 14th day of May 2026 brought under Section 71 (3) of the Law of Succession Act Cap 160 Laws of Kenya. The Applicants are seeking orders:
(a) That the grant of letters of administration intestate made to the said Beatrice Aleyo Ayimbo and Elvis Ayimbo Sichenga in this matter on 23rd April, 2025 be confirmed.
(b) That costs of this application be in the cause.
2. The application is supported by the affidavit of Beatrice Aleyo Ayimbo who deponed as follows:
i. THAT I am a female adult of sound mind and disposition, the administrator /applicant herein hence competent to swear this affidavit.
ii. THAT the court appointed me as administrator in the estate of George Ayimbo Lukobo Alias George Ayimbo Sichenga (Deceased).
iii. THAT the deceased died leaving the following surviving him:

3. The Petitioners deposed that no estate duty is payable in respect of the estate of the deceased and referred to an Estate Duty Compliance
Certificate. The Petitioner further prayed that the said Grant be confirmed.
Decision
4. I have considered the summons for confirmation of grant, the affidavit in support and the consent from the beneficiaries and I am satisfied that the criteria under Section 71 of the Law of Succession Act has been met by the Administrators for the Certificate of Confirmation of Grant be issued by this Court for purpose of transmitting the share of the estate to the beneficiaries. The Administrators are expected to complete distribution within six (6) months and subsequently file a probate account under Section 83 of the Act and have the estate liquidated forthwith.
