HON. LEMPAIRA NICHOLAS VS County Assembly of Laikipia AND County Assembly of Laikipia Speaker AND 2 Others

High Court at Nanyuki High Court · · Anthony Ndungu

' I have had occsion to consider the Notice of Motion brought under a certificate of urgency filed contemporaneously with the Costitutional Petition dated 3/12/25. For reasons stated, i certify the matter as urgent and admit the same to hearing ex parte in the 1st instance. On the material before court, am satisfied that the Motion, and indeed , the Petition, would be rendered nugatory should the impugned action proceed as any monies re-allocated and /or spent would not be recoverable.
In the premises, i allow interim injuctory/conservatory orders in terms of prayer 2 and 3 pending mention inter partes.
The Motion and Petition be served. Response in 7 days.  Leave for a supplementary afffidavit granted to be exercised within 2 days of service of respponse.
Mention on 15.12.25
