(From the original Conviction and Sentence in the Chief Magistrates’ Court at Nyamira, Criminal Case No. E1182 of 2023 by Hon. B.A. Jumar, Resident Magistrate on 24th January 2024)
The Applicants were convicted on their own plea of guilty for the offences of house breaking contrary to Section 304 (1) (b) and Stealing contrary to Section 279 (B) of the Penal Code. The trial court sentenced each of them to serve 2 years’ imprisonment and ordered each of them to compensate the complainant in the sum of Kshs. 70,000/=. The Applicants have served 2 months of their sentences. The Sentence Review Reports filed on 3rd April 2024 by the Probation Officer Samwel Chuma in respect of the 1st and 2nd Applicants do not recommend a non-custodial sentence. I hereby direct that the Applicants continue to serve the remaining part of their sentences in custody.
Orders accordingly.
