1. The Court is seized of a Chamber Summons application dated 10th March 2025, filed by the firm of Kurauka & Company Advocates. The application is brought pursuant to Order 9 Rule 13(1) of the Civil Procedure Rules and Section 3A of the Civil Procedure Act. The applicant seeks leave of the Court to cease acting for the 2nd defendant in these proceedings.
2. The application is supported by an affidavit of service, which confirms that it was duly served upon the 2nd defendant (the client) and all other parties to the suit. Notably, no response or objection has been filed by any of the parties. The application is therefore unopposed.
3. I am satisfied that there is no legal impediment to the firm’s withdrawal and, there being no objection or exceptional circumstances, the application is merited.
Disposition
4. Accordingly, the Chamber Summons application dated 10th March 2025 is hereby allowed. Leave is granted to the firm of Kurauka & Company Advocates to cease acting for the 2nd defendant in this matter.
5. The said firm shall forthwith serve this order upon the 2nd defendant, and shall file an affidavit of service within seven (7) days from the date hereof.
