1. The Court is seized of the Chamber Summons application dated 8th November 2024 brought by the firm of Kithinji Marete & Company Advocates, under the provisions of Order 9 Rule 13 of the Civil Procedure Rules and Section 3A of the Civil Procedure Act, seeking leave to cease acting for the Plaintiff in this matter.
2. The application is accompanied by an affidavit of service sworn on 27th June 2025 confirming that the application was duly served upon both the Plaintiff/Client. The application has equally been served upon the Defendants.
3. None of the parties has filed any response or raised an objection. The application is therefore unopposed. In the absence of any legal bar to the firm’s withdrawal, and the Court having found no justifiable reason to decline the prayer, the application is meritorious and fit for granting.
Disposition
Accordingly,
i. The application dated 8th November 2024 is hereby allowed. Leave is granted to the firm of Kithinji Marete & Company Advocates to cease acting for the Plaintiff in this matter.
ii. The said firm shall, within seven (7) days from the date hereof, serve this order and a mention notice upon the Plaintiff and file a certificate of service as required.
