I have perused the application dated 8.12,22. brought under a certificate of urgency. On the basis of grounds raised, I decline to certify matter as urgent.
Upon considering the chamber summons, the grounds relied upon as gleaned from the statutory statement and the verifying affidavit, am satisfied that an arguable case is established warranting the grant of leave sought.
I accordingly grant leave in terms of prayer 1. It is directed as follows;
1. The substantive Motion be taken out and served within 21 days.
2. Response be filed within 14 days of service.
3. Matter shall be disposed of by way of written submissions.
4. The applicant to file within 14 days of service of response.
5. The Respondent to file within 14 days of service of rival submissions.
