I have perused the Application dated 13th February, 2023 brought under a Certificate of Urgency. On the basis of grounds raised, I do hereby certify the matter as urgent.
Upon considering the Chamber Summons, the grounds relied upon as gleaned from the Statutory Statement and the Verifying Affidavit, am satisfied that an arguable case is established warranting the grant of leave sought.
Order:
1. Leave is hereby granted in terms of prayer 1.
2. The substantive Application shall be filed and served within 21 days.
3. The Respondents shall file their responses within 14 days of service.
4. The Ex parte Applicant shall thereafter file and serve written submissions within 14 days.
5. The Respondents shall then file their submissions within 14 days of service.
6. The matter shall be mentioned on 18th April, 2023 for further directions.
