I have read the applicant's application dated 24 July 2023 filed under a certificate of urgency of even date. The application is hereby certified urgent. Leave is granted in terms of prayers 2 and 3 of the summons. The prayer for leave to operate as stay is, however, declined. The substantive motion to be filed and served within 7 days of the date of this ruling. The respondents to file and serve their response within seven days of the date of service of the applicant's motion. The suit shall be mentioned in the new term on 26 September 2023 for directions on the manner of its disposal. It is so ordered.
