COFFEE MANAGEMENT SERVICES LIMITED VS NAIROBI COFFEE EXCHANGE AND CAPITAL MARKETS AUTHORITY

High Court at Milimani High Court · · Jairus Ngaah

I have considered the application is dated 9 May 2024 filed under a certificate of urgency of even date. In my previous directions, I directed that the question of whether the applicant merits exemption from exhaustion of alternative procedures or remedies should be determined first before the court proceeds any further. For this reason I scheduled the matter for hearing on 13 May 2024 when this question can be disposed of. That being the case, there is no basis upon which the court can grant interim relief at this particular stage. The court has to consider, as a preliminary point, whether the application is properly before court before it can issue  any substantive orders. Accordingly, I directed at this application be heard on 13 May 2024. It is so ordered.
