1. By an ex parte Notice of Motion dated 4th August 2025, brought under Section 888 of the Companies Act, 2015 of the Laws of Kenya, BANK OF BARODA LIMITED, hereinafter the Applicant, seeks, among others, the following orders: -
“THAT the time for registration under section 888 of the Companies Act No. 17 of 2015 of the Further Charge, particulars whereof are given herewith, be extended by 30 days from the date of the Order to be made herein.”
2. The application is based on the grounds enumerated on the face of the application, and is supported by the affidavit of PARTH PRAVINCHANDRA KAKAD, an Advocate at the law firm of P.J Kakad & Company Advocates LLP.
3. I have carefully perused and considered the application and note that no specific particulars of the charged property in respect of which the extension is being sought has been outlined on the face the application. The application is therefore incompetent in that respect.
4. Consequently, the application is hereby struck out but with leave to the applicant to file a fresh and competent application.
5. It is so ordered.
