1. By an ex parte application dated 24th March 2025, brought under sections 888 of the Companies Act 2015, BANK OF BARODA (KENYA) LIMITED, hereinafter the applicant seeks extension of time for thirty (30) days to allow for the registration of Charge dated 31st January 2025 in favour of the applicant.
2. The application is said to be based on the reasons stated in the supporting affidavit of PARTH PRAVINCHANDRA KAKAD.
3. I have perused the application filed herein and note that the said supporting affidavit of PARTH PRAVINCHANDRA KAKAD is not complete. Paragraphs 1 to 3 of the affidavit are missing.
4. In the premises, I hereby strike out the Applicant’s application dated 24th March 2025 for being incompetent. The applicant is, however, at liberty to file a fresh application.
5. There shall be no orders as to costs.
6. It is so ordered.
