ABDUL TWALIB ALIAS KIBABUU VS The Republic

High Court at Garsen High Court · · Jesse Nyagah

1. The Applicant has filled an undated application seeking for review of his sentence of 20 years imprisonment on a conviction for the offence of defilement under Section 8(1) as read with section 8(3) of the Sexual Offences Act. The grounds in support of the applicant are that he has served 5 years of the sentence imposed on him and is now rehabilitated. That he was a first offender when he committed the offence.

2. I have considered the grounds in support of the application. It is in the first place important to note that the Applicant was sentenced by a magistrate’s court. He appealed to the High Court and his sentence of 20 years imprisonment was upheld.

3. Secondly, I do note that the applicant was facing a serious charge of defiling a child of the age of 13 years. He is a married with a family of his own. He simply took advantage of a vulnerable child. I do not see any merit in the application for review of sentence and the same is declined.

In the presence of:

Mr. Oluoch for Respondent

Applicant: Present virtually at GK Prison Malindi
