Data Protection Audits
Data protection gap audits and DPIAs.
A data protection audit is a systematic, independent assessment of an organisation's compliance with the Data Protection Act, 2019 and the regulations issued by the Office of the Data Protection Commissioner (ODPC). The audit reviews the organisation's data processing activities, its policies and procedures, its technical and organisational security measures, and its compliance with the principles of data protection — lawfulness, fairness, transparency, purpose limitation, data minimisation, accuracy, storage limitation, integrity and confidentiality, and accountability. A data protection audit is not just a compliance exercise — it is a risk management tool that identifies vulnerabilities, prevents data breaches, and protects the organisation from regulatory enforcement and reputational damage.
This service follows a structured methodology. Advocates begin with a scoping exercise — identifying the organisation's business units, systems, and processes that fall within the scope of the audit, and determining the depth and breadth of the review. Advocates then conduct a data mapping exercise — identifying the personal data that the organisation processes, the sources of the data, the purposes of the processing, the legal bases relied upon, the recipients of the data, any cross-border transfers, the retention periods, and the security measures in place.
Advocates review the organisation's data protection governance framework — including the appointment of a Data Protection Officer (where required), the data protection policy, the data protection impact assessment procedures, the data breach response plan, and the data subject rights handling procedures. Advocates assess whether the governance framework is adequate and whether it is being implemented in practice.
Advocates review the organisation's data protection documentation — including the privacy policy, the data processing agreements with processors, the data sharing agreements with third parties, the data retention policy, and the records of processing activities (which are required under the Data Protection Act). Advocates assess whether the documentation is complete, accurate, and up to date, and whether it complies with the transparency and accountability requirements of the Act.
Advocates review the organisation's technical and organisational security measures — including access controls, encryption, firewalls, intrusion detection systems, staff training, and incident response procedures. Advocates assess whether the security measures are appropriate to the risk — taking into account the sensitivity of the personal data, the volume of data processed, and the potential impact of a data breach on the data subjects.
Advocates prepare a comprehensive audit report that sets out their findings, identifies the areas of non-compliance, assesses the risk level of each finding, and recommends remediation measures. Advocates prioritise the recommendations based on the risk level and the ease of implementation, and they provide a practical, actionable remediation plan that the organisation can implement.
Advocates also assist with the implementation of the remediation plan — preparing the revised policies and procedures, drafting the data processing agreements and privacy policies, conducting the data protection impact assessments, and training the staff on their data protection obligations. Advocates provide ongoing support to ensure that the organisation maintains compliance over time, and they conduct follow-up audits to verify that the remediation measures have been implemented effectively.
For organisations that are subject to ODPC inspections or investigations, they assist with the preparation for the inspection, the management of the inspection process, and the response to any findings or enforcement actions.
