JudgmentStella Nkatha Kebongo VS Barclays Bank of Kenya Limited
Employment and Labour Relations Court at Nairobi Employment and Labour Relations Court (ELRC)J. N. Abuodha
Division and case type: Claims and Labour Relations Division·Claim/Causes
The Claimant, who had worked with the Respondent for nearly twenty years, was suspended multiple times between November 2016 and March 2017 based on allegations of inflated performance scores and improper leave approvals. The Claimant alleged that the Respondent's management (including her line manager Mr. Achoki) fabricated show cause letters and suspended her without proper investigation, despite her branch's performance scores being verified at 102.2% in 2016. The court found that the Respondent's actions were unlawful as they violated the Claimant's rights to fair hearing and due process, particularly given the lack of evidence supporting the allegations and the Respondent's awareness of the discrepancies in the performance scores. The court restrained the Respondent from further disciplinary proceedings.

Employment and Labour Relations Court at Nairobi Employment and Labour Relations Court (ELRC)Ocharo Kebira
Division and case type: Claims and Labour Relations Division·Claim/Causes
The Claimant, as the widow of the deceased Professor Fredrick Otieno, substituted herself as the administratrix of his estate after the deceased's death. She sought declarations and compensation for unlawful termination of employment as Vice Chancellor and Professor, arguing that the termination was unfair, wrongful, and unprocedural due to the Council's decision influenced by an undisclosed Ethics and Anti-Corruption Commission letter, lack of due process, and the termination of both roles without proper contractual renewal. The Respondent denied the claim, asserting the deceased was never properly appointed as a Professor and that the termination followed due process despite investigations. The court granted the Claimant's application to substitute the deceased as administratrix and allowed the amended claim to proceed.
