I have considered the application and the submissions.

Parties are in agreement that the 9th Defendant passed away. A perusal of the Amended Plaint shows that one of the titles sought to be cancelled is that of the 9th Defendant. In those circumstances, there will be need for substitution as otherwise the Plaintiffs’ claim against the 9th Defendant will abate.

I also bear in mind that the parties are closely related and that the bereavement applies across board.

I find merit in the application for adjournment and I allow it. The same also applies to the hearing scheduled for 15th April 2026.
