1. I have read the applicant's 2 applications both dated 14 August 2025. The applicant seeks the substantive motion be heard during this Honourable Court's August Recess.
2. I have considered the motion and I am satisfied it is urgent. I am also satisfied that the applicant deserves interim orders in terms of prayers 2, 3, 4 and 6 of the motion.
3. Further subject to payment of any charges, including port charges, storage charges, demurrage charges, taxes, duties or levies that may be due to the Kenya Ports Authority, Kenya Revenue Authority or any other government or private entity; and subejct to the applicant providing indemnity to the 1st to 4th defendants, in the event they exist, or any other person who may have a legitimate claim on the consignment of goods, an order is hereby issued directing the Fifth and Sixth Respondents to immediately release the containers bearing numbers SELU4015397, BEAU6400681, TGCU5281316 and TGCU5326318 to the applicant pending the hearing and determination of this suit.
4. The matter shall be mentioned in court for further directions on 23 September 2025.
5. In the meantime, the applicant is directed to serve the application and the suit on the defendants personally, where it is practicable, and by way of email, using the last email address through which the applicant communicated with the defendants or any of them. It is so ordered.
