This Ruling pertains to the Appellant’s Notice of Motion dated 28/01/2025. I have seen the Affidavit of Service sworn by Victor Mutingu and I am satisfied that the Respondents were duly served with the Application electronically on 19th January 2025. They have not filed their responses as directed by this court and hence the application is unopposed. In the premises the same is allowed but on condition that the Appellant/Applicant shall deposit the entire decretal sum in an interest earning account in the names of counsel for all the parties within 21 days of todays date.
The Appeal be mentioned for directions on 4/03/2025, counsel for the Appellant to file and serve Record of Appeal within the same 21 days and the Deputy Registrar to call for the record of the lower court.
