JUDGEMENT

By consent this matter is hereby settled in the following manner;

1. A permanent injunction be and is hereby issued directed at the Defendant herein, its directors and/or shareholders, employees, beneficiaries of its interest in law or otherwise, servant or agents, howsoever restraining them from removing or in any way interfering with the Plaintiff’s continued occupation and/or possession and operations and use of all those properties being title number ELDORET MUNICIPALITY/BLOCK 8/808 and ELDORET MUNICIPALITY/8/809 as guaranteed under the Lease dated 30^th June 2014 and made between the Plaintiff and the Defendant.
2. A declaration that Vivo Energy Kenya Limited, the Plaintiff herein, has rights as the registered Lessee in respect of all properties being title number ELDORET MUNICIPALITY/BLOCK 8/808 and ELDORET MUNICIPALITY/BLOCK 8/809 and is entitled to have quite possession and user in accordance with the terms of the Lease dated 30^th June 2014 and registered on an even date.
3. There will be no costs.
4. The file is hereby closed.
