1. I have considered the Applicant’s notice of motion dated 23.1.2024, the affidavit in support thereof and the submission filed herein on 25.1.2024 and I note that a court of concurrent jurisdiction did rule on his appeal on 23rd March, 2021 and dismissed the same. This court is thus functus officio and I thus proceed to dismiss it with costs.
