RULING

1. This matter is being handled by Judge Nzili who is on official annual leave.
2. The Court has taken note that the 13^th Defendant has been duly arrested for contempt of court.
3. However, this Court is of the view that it is not well versed with the history and dispute at hand and it will be not fair to sentence the 13^th Defendant in this circumstances.
4. Consequently, the Counsel for the 13^th Defendant Mr. Felix Mukabane P.105/9552/12 hereby gives his professional undertaking to avail the 13^th Defendant in Court on 11^th June, 2025.
5. Based on this professional undertaking, the 13^th Defendant is hereby released but is directed to report to the OCS Kapenguria on 19^th May, 2025 to confirm his appearance.
6. The Deputy Registrar Kitale – ELC should ensure that he/she get all the information, contact numbers and place of residence of the 13^th Defendant for ease of tracing.
