Introduction and Background
This Court previously issued a garnishee order nisi pursuant to the Plaintiffs’/ Decree Holders’ Notice of Motion application dated 21st April 2026. The Garnishee has since filed a response confirming that the funds held in the garnisheed account are sufficient to satisfy the outstanding decretal sum of Kshs. 674,064/=, being the amount remaining due under the decree issued on 4th June 2025.
Accordingly, prayer 3 of the Notice of Motion dated 21st April 2026 is hereby allowed. A garnishee order absolute is hereby issued directing the Garnishee to remit to the Plaintiffs/Decree Holders the sum of Kshs. 674,064/=, being the full amount outstanding under the decree of 4th June 2025, from the garnisheed account number *****7047 held in the name of AIVEO DISTRIBUTORS LIMITED together with costs assessed at Kshs. 45,000/=. The Garnishee's costs, assessed at Kshs. 30,000/=, shall also be deducted from the garnisheed account prior to remittance and paid directly to the Garnishee.
