I have read the applicant's application dated 12 April 2024 filed under certificate of urgency of even date. I am satisfied that the application is urgent and it is so certified. Leave is granted to institute judicial review proceedings for judicial review reliefs in terms of prayers 2, 3 and 4 of the chamber summons. The application for leave to operate as stay is, however, declined for the reason that the elections sought to be stayed are scheduled to be held today, 15 April 2024. It is not clear whether, at the time of making this order, the elections have been held or not. Nonetheless, the applicant is directed to file and serve the substantive motion within 7 days of the date of this ruling. The respondents and interested parties are directed to file and serve their response within 7 days of the date of service of the applicant's motion. The directions on the hearing of the motion shall be on 30 April 2024. It is so ordered.
