1. The court allowed the application dated 12th August, 2024 and scheduled this day of examination of directors.
2. I am satisfied that the directors were served with summons to appear in court for this purpose. They have failed to honour the summons. No reasons have been given for their absence. I am left with no choice but to infer an inability of the company to satisfy the decretal amount. In light of the ruling of 22nd May, 2025 I hereby grant prayer 4 of the said application, lifting the corporate veil of the respondent company.
3. Accordingly, the directors of the respondent company, namely Joseph O. Agola, Martin Munene Njenga and Teresiah Nyambura Gathu shall and are hereby held personally liable for the decretal amount herein. The applicant shall have the costs of the application.
