The Appellant’s application dated 13.03.2023 seeks a stay of execution pending appeal. The only issue is nature and extent of security to be offered by the Appellant. Counsel for the Respondent accepts deposit of the decretal amount in a joint account. The application is allowed on terms that execution is stayed on the following terms:
1. The Appellant shall deposit the decretal amount of Kshs. 550,000.00 in a joint account to be agreed by the Advocates within 14 days failing which the amount shall be deposited in court.
2. The Appellant shall pay the Respondent costs of Kshs. 15,000.00 within 14 days.
3. In default of compliance of the aforesaid terms, the stay order shall lapse automatically.
4. The stay order shall remain in force a period of 6 months unless extended by this court.
5. Mention on 27.04.2023 for directions on the appeal.
