Whereas this case was fixed for hearing today by consent of parties on 27.3.2025, neither the plaintiff nor its advocates have attended court. Mr. Okaka counsel holding brief for Mr. Anwar for the defendant has applied for the dismissal of the plaint for want of attendance. I am inclined to allow that application. I thus dismiss the plaint herein for want o attendance with costs to the defendant.
The defendants counter-claim is fixed for hearing on 14.7.2025. the defendant’s counsel is hereby directed to issue a hearing notice to the plaintiff’s advocates.
