1. Before the court is the plaintiff’s request for interlocutory judgment under order 10 rules 6, 9 and 10 of the Civil Procedure Rules. It is dated 30th January, 2024.
2. I have considered the evidence in support of the same and I am satisfied that the defendant was served and has failed to enter appearance or file a defence as required by law.
3. As such I hereby enter judgment for USD 765,430 together with interest at court rates from the date of filing suit until payment in full as well as a permanent injunction restraining the defendant whether by themselves, their employees, servants and/or agents or anyone claiming under them from removing from the Wilson Airport, selling, leasing to 3rd parties charging, mortgaging, encumbering, alienation, disposing off, transferring to a 3rd party, washing away, dealing or interfering in any manner with the aircraft registration 5YTAJ unless otherwise a sum of USD 765,430 claimed in this suit or such security as may be sufficient to satisfy the said amount or decree passed against the defendants together with costs is duly paid.
